Privacy Policy

This privacy policy (the “Privacy Policy”) relates to the information collection and use practices of Lead Offer LLC d/b/a Leadoff (“Leadoff”, “we,” “us,” and/or “our”) in connection with our website www.useleadoff.com (the “Site”) and our services (together with the Site, the “Platform”). 

BY ACCESSING AND USING THE PLATFORM, YOU ARE ACKNOWLEDGING THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS PRIVACY POLICY AND THE TERMS AND CONDITIONS LISTED IN YOUR LEADOFF PARTICIPATION AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS IN THIS PRIVACY POLICY AND YOUR LEADOFF PARTICIPATION AGREEMENT, YOU MAY NOT ACCESS OR USE THE PLATFORM.

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Leadoff Participation Agreement.

The Information We Collect and Receive
In the course of operating the Platform and the Program, we will collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information.

1. Contact Information - When you register for the Program by signing the Leadoff Participation Agreement, you share your contact information directly and/or you authorize Leadoff to collect your contact information from your mortgage lender. Such information may include your name, address, e-mail address and phone number. 

2. Personal Information - As part of the Leadoff Participation Agreement, you also permit your mortgage lender to provide Leadoff with information from your personal credit profile or other information from one or more consumer reporting agencies. This information may include your credit history, financial information, and other sensitive personal data. 

3. Agent and Loan Officer Information - When you interact with Leadoff as an Agent or Loan Officer, you may be required to provide us with your first name, last name, phone number and email address. For verification, Agents may further be required to provide their Multiple Listing Service (“MLS”) identification number, and Loan Officers may be required to provide their Nationwide Multistate Licensing System (“NMLS”) identification number.

4. Other InformationLeadoff may also collect additional information (collectively, the “Other Information”). Such Other Information may include:

a) From You - Additional information about yourself that you voluntarily provide to us, such as personal interests, and your product and service preferences.

b) From Your Activity - Additional information that we automatically collect when you use the Platform, including, without limitation: IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or device; Browser type and language; Referring and exit pages and URLs; Date and time; Details regarding your activity on the Platform, such as amount of time spent viewing pages, and other performance and usage data.

c) About Your Device - Type of device; Operating system and version (e.g., iOS, Android or Windows); Carrier; and Network type (WiFi, 3G, 4G, LTE).

d) From Cookies - Leadoff, and/or third-party service providers, collect information using “cookie” technology. Cookies are small packets of data that a website stores on your computer’s or mobile device’s hard drive so that your computer will “remember” information about your visit to our Platform. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to help us collect information and to enhance your experience using the Platform.  If you do not want us to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device.  Please consult your Internet browser’s documentation for information on how to do this and how to delete persistent cookies.  

e) From Third Parties - Leadoff may use one or more third-party analytics services to evaluate your use of the Platform, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to usage of the Site. These third parties use cookies and other technologies to help analyze and provide us the data. You consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy.

f) From Other Sources - We also may collect or receive information from third parties, such as instant messaging platforms, customer relationship management tools, and/or other third-party sources in accordance with their privacy policies. If you communicate with us via live chat, we collect information provided in such communications.  This may include chat transcripts. Some of this information is collected on our behalf by third-party service providers.

The Information Collected by Third-Party Advertising Companies
You authorize us to share Other Information about you with third parties, including, but not limited to, advertising and remarketing providers, or other brand partners, for purposes of personalizing or otherwise understanding how you engage with ads or other content. These third parties may use cookies, pixel tags (also called web beacons or clear gifs), or other technologies to collect Other Information in furtherance of such purposes, including to tailor, target (i.e., behavioral, contextual, retargeting, and remarketing), analyze, report on, and/or manage advertising campaigns or other initiatives. For example, when a browser visits a site, pixel tags enable such third-parties to recognize certain cookies stored within the browser to learn which ads or other content bring a user to a given site. In addition, we may collect Other Information from these third parties, including through their service providers, such as advertising identifiers, IP addresses, and post-conversion data and Contact Information, and/or similar information collected through other digital properties.

Below is a list of advertising/remarketing providers that we use; however, such list may be subject to change based on the campaigns we wish to run. You may use the accompanying links to learn more about such providers and, if available, how to opt-out from certain data collection, their targeted ads, or other personalization features. Please note you will not necessarily be opted-out of advertising or content generally; you may still receive generic ads or content.

For Google Adwords: you can set preferences for how Google advertises to you using the Google Ad Preferences page https://adssettings.google.com/authenticated, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

How We Use and Share the Information
We use  Contact Information, Personal Information, Agent and Loan Officer Information and Other Information (collectively, “Information”) to provide you the Platform and the Program, solicit your feedback, and to improve our services to you. Also, we may share Information as described below, to the extent not prohibited by Applicable Laws.

- In an ongoing effort to better understand our users and our Platform, we might analyze the Information in aggregate form in order to operate, maintain, manage, and improve the Platform. This aggregate information does not identify you personally.

- We may share and/or license this aggregate data with our affiliates, agents, and business partners, and other third parties. We may also disclose aggregated user statistics in order to describe our Program and the Platform to current and prospective business partners and to other third parties for other lawful purposes.

- We may employ other companies and individuals to perform functions on our behalf. Examples may include companies and individuals providing marketing assistance, information technology support, database maintenance and customer service. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law. Our contracts with all such third parties require them to protect the confidentiality of the Information we provide to them.

- We may share some or all of your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us.

- As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets.

- To the extent permitted by law, we may also disclose the Information when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of Leadoff, our users, or others.

If Leadoff intends on using your Information in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Information is collected.

Sharing of Your Information with Non-Affiliated Third Parties
We will not share your Contact Information with non-affiliated third parties that may use such information to market to you, without obtaining your opt-in consent. For example, we may offer you a product opportunity that requires us to share your Contact Information with non-affiliated third parties that may use such information to market to you. We will obtain your opt-in consent to such sharing of your Contact Information when we present you with the terms of such offer. If you have opted-in for this kind of sharing, then you may: (i) choose to opt-out of such sharing by contacting us at (ii) requescertain information regarding our disclosure of such information to such non-affiliated third parties by contacting us at.

How We Protect Your Information
We take commercially reasonable steps to protect your Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable.  We cannot guarantee the security of our databases, nor can we guarantee that your Information will not be intercepted while being transmitted to and from us over the Internet. 

Leadoff shall comply with all Applicable Laws, including, without limitation, the Gramm-Leach-Bliley Act, California Civil Code § 1785.20.2 (if applicable), and all Applicable Laws relating to data privacy, data security, international communications, communications decency, and the importation and exportation of materials and data.

Modifying Contact Information and Communication Preferences
You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any Leadoff marketing email. Participants cannot opt out of receiving transactional emails related to their account. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases.

Important Notice to Non-U.S. Residents
The Platform and our servers are operated in the United States. Please be aware that your Information, including personal information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your country of origin. If you are located outside the United States and choose to use the Platform, you do so at your own risk.

Children
We do not knowingly collect personal information from children under the age of 13 through the Platform. If you are under 13, please do not give us any personal information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide personal information through the Platform without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us, please contact us, and we will endeavor to delete that information from our databases.

California Privacy Rights
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. Nevada Privacy Rights
If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by sending a letter or postcard to "Request for NV Disclosure Choices" to the address on the Leadoff home page. and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. 

Virginia Privacy Rights
If you are a resident of Virginia, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by sending a letter or postcard to "Request for VA Disclosure Choices" to the address on the Leadoff home page. and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Virginia Consumer Data Protection Act (Code of Virginia Chapter 53).

Colorado Privacy Rights
Pursuant to Section 6-1-1306 (1)(a)(III) of the Colorado Revised Statutes, Colorado residents have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. If you wish to submit a request pursuant to opt-out, please send a letter or postcard to "Request for CO Disclosure Choices" to the address on the Leadoff home page and provide us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Colorado Privacy Act (Colorado Revised Statutes Title 6, Article 1, Part 13).

Utah Privacy Rights
Pursuant to Section 13-61-302(3)(a) of the Utah Code, Utah residents have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right under Utah Consumer Privacy Act by sending a letter or postcard to "Request for UT Disclosure Choices" to the address on the Leadoff home page and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Utah Code Section 13, Chapter 61.

Connecticut Privacy Rights
If you are a resident of Connecticut, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by sending a letter or postcard to "Request for CT Disclosure Choices" to the address on the Leadoff home page. and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Connecticut Data Privacy Act.

Do Not Track
Leadoff does not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

External Websites
The Platform may contain links to third-party websites. Leadoff has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other websites to which we provide links. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

Changes to This Privacy Policy
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy.  We may change this Privacy Policy from time to time. Any such changes will be posted on the Platform.  By accessing the Platform after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes.  Please be aware that, to the extent permitted by applicable law, our use of Information is governed by the Privacy Policy in current effect.  Please refer back to this Privacy Policy on a regular basis.
